1. Informational Nature of the Service

1.1. The Orfi Service provides tools for the visualization and analysis of cryptocurrency market data and is exclusively informational and analytical in nature.

1.2. No information, data, charts, indicators, signals, analytics or other materials of the Service constitute or shall be regarded as:

  • an individual investment recommendation;
  • financial, investment, tax, legal or accounting advice;
  • an offer, inducement or recommendation to enter into any transactions;
  • a guarantee of any result or return.

1.3. The Administration of the Service is not a professional participant of the securities market, an investment adviser, a broker, a dealer, an asset manager or any other licensed entity of the financial market, and does not provide the corresponding services (including within the meaning of Federal Law No. 39-FZ of 22.04.1996 "On the Securities Market").

1.4. All decisions taken by the User on the basis of information from the Service are taken by the User independently, at the User's own discretion and at the User's own risk.

2. Risks of Cryptocurrency Trading

2.1. Trading in cryptocurrencies and derivative instruments involves a high level of risk and may lead to the full or partial loss of the funds invested.

2.2. The User acknowledges and accepts, in particular, the following risks:

  • high volatility and unpredictability of prices;
  • the risk of a total loss of capital, including as a result of the liquidation of positions when trading with leverage;
  • slippage, execution delays, unavailability or failures of exchanges;
  • technical, market, regulatory and other risks.

2.3. Past results do not guarantee future results. Any historical data, metrics and examples are illustrative in nature.

2.4. The User should not trade with funds the loss of which the User cannot afford.

3. Third-Party Data

3.1. The data displayed in the Service (quotes, volumes, the order book, trades, metrics) is received from external sources — cryptocurrency exchanges and market data providers.

3.2. The Administration does not warrant the accuracy, completeness, timeliness or uninterrupted delivery of such data and shall not be liable for errors, delays, omissions or unavailability of the data, or for decisions taken by the User on the basis of it.

4. Trading Module

4.1. The Trading Module allows the User, at the User's own initiative, to connect exchange API keys in order to view account data and/or to submit trading orders.

4.2. The User bears sole and full responsibility for:

  • all trading decisions and orders submitted;
  • the management of API keys and the scope of the permissions granted to the exchange (it is recommended to disable the withdrawal permission);
  • the safekeeping of the User's keys and credentials;
  • any losses, liquidations and other consequences of the transactions performed.

4.3. The Administration is not a party to the transactions of the User, does not manage the funds of the User, has no access to them and does not warrant the correctness or timeliness of the execution of orders on the side of the exchange, or that such execution will take place at all.

4.4. No fiduciary, brokerage, agency or trust relationship arises between the User and the Administration.

5. Provision "As Is"

5.1. The Service is provided on an "as is" and "as available" basis, without any warranties, express or implied, including warranties of fitness for a particular purpose and of uninterrupted operation.

5.2. The Administration does not warrant the absence of errors and failures or the continuous availability of the Service, and is entitled to suspend its operation for maintenance.

6. Limitation of Liability

6.1. To the maximum extent permitted by applicable law, the Administration shall not be liable for any direct or indirect damages, lost profits, or loss of data or funds arising in connection with the use of, or the inability to use, the Service and the Trading Module, including trading losses and the consequences of the User's transactions.

6.2. The aggregate liability of the Administration, if any is established, is limited to the amount actually paid by the User for the Subscription for the last paid period.

7. Compliance with the Law Applicable to the User

7.1. The circulation of cryptocurrencies and operations with them are regulated differently in different jurisdictions and in certain countries may be restricted or prohibited.

7.2. The User independently ensures that the User's actions comply with the legislation of the jurisdiction applicable to the User, including tax and currency control requirements, and bears responsibility for non-compliance with it.

7.3. Use of the Service does not constitute an offering of its services to persons in jurisdictions where this would be contrary to law.

8. Final Provisions

8.1. This Disclaimer may be amended by the Administration; the current revision is published at https://orfi.tech/legal/disclaimer.

8.2. If any individual provision is held invalid, the remaining provisions remain in force.
